Abstract

1012, overlapped to windward outside 923 at the windward mark did not give 923 mark-room and did not keep clear.

Facts Found

1. 1012 was not present at the hearing.
2. 1028, 923 and 1012 were approaching the windward mark on starboard tack
3. At the zone 1028 was overlapped inside to windward of  923 and 923 was overlapped to windward inside 1012.
4. At one boatlength from the mark 1012 attempted to pass astern of 923.
5. 1012 collided with the stern of 923.
6. 923 hailed ‘protest’.
7. No boat carried out a penalty turn.

Conclusion

1. As 1012 was overlapped on 923 at the zone she was required to keep clear of 923 until 923 had rounded and cleared the mark. 
2. 1012 did not give 923 mark-room as required by rule 18.2
